I am impressed! Thank you, Nancy Teicheira and MUSD staff!

Beginning around 8:00 this morning, personnel from the Manteca Unified School District actually followed through on one of my suggestions for relieving traffic pressure, blood pressure, and bladder and bowel pressure - all at the same time. Noted on the picture above is Fishback Street's new gate onto the practice field.

The offending after-school Pop Warner Football and Cheer drivers can now drop off and pick up their precious Johnnies and Suzies without stoppering up my driveway. Those who stay all night - the block party parasites - their offensive communal collection of bodily effluents can also be moved farther away from its original placement on my driveway; better their spawn play downwind of it, than I suffer it.

Ms. Reynolds' song is a scathing swipe at the urban development patterns of Daly City, across the bay from San Leandro, but easily lends itself to any and all up-the-hillside developments.

The song also has direct application to Lyin' Lynda's half-acre compound on semi-rural Fishback Street (but still R-1 zoning) in flat-as-a-pancake Manteca, California. Every time I see L/L's pot shacks, or smell the odiferous cloud billowing from her Smokehouse, this song runs through my head.

During L/L's first season it was the big, white tent for her Wacky Tabacky (click Weeds Season 1, Episode 5 for the song by the NRBQ).

Then L/L's second season starts off with the Ticky-Tacky growing sheds ...


... kinda like houses and hotels on a Monopoly(c) Park Avenue...

...or whatever the heck those folks in the UK use as place names.

... or, a line of TLC migrant worker houses.

My recently acquired insights into the seamy scam known as the Compaaaasionate Use Act of 1996 (aka, California's Medical Marijuana law; aka, de facto legalization):
  • pushed by evil (the kingpin power brokers and money launderers)
  • enacted by greed and blackmail (purchased lawyers masquerading as state legislators)
  • abetted by corruption (toothless, spineless local politicians; hamstrung or dirty law enforcement; and a morbidly obese and deadly flatulent legal system)
  • abused by riff-raff (the parasitic "takers" of society, who voted themselves a legal "right" to stupidity and given a special entitlement of protected status)
  • protected and enforced by violent scum (street muscle who extort, rape, and kill the gold-laying geese)
  • allowed to exist by the completely apathetic ("none of my business"), or the futily disorganized and ineffectual ("what can one person do?"), or the abjectly misguided ("victimless crime", "revenue source", "free country") majority of residents of the Great State of California.

And where did that second TLC Catering truck go? I suppose the BDG's are going to grow their primo weed here in Manteca and distribute it elsewhere via a network of Asian/Indian/Mexican catering trucks. What a perfect retail cover business! Cash business; low inventories: extreme mobility for sales, sales prospecting, and bulk movements; malleable menu condiments ("Want I sprinkle summa this guarnición on that for ya?"); deep fryers, grease traps, toilets for contraband disappearance before a bust; "no speek eenglase" defense while being questioned.

Of course, it'd be lots easier just to poke packets through the chain link fence between them and the high school. (But none of the three looks like Mary-Louise Parker! "We show you our faces, You're gone without traces..."  just sayin'...)

And the grow shed power consumption problem? "No problem!" crows Lyin' Lynda. "We got us'ns seven huge solar panels on the property to run these here growing sheds."

Of course, the Manteca Building Permit Department did NOT issue a permit for the photovoltaic system to Lyin' Lynda Allen. No... for some unknown reason, the photovoltaic permit was issued in 2004 to build the system on L/L's property, but the owners of the system were listed as the next door octogenarians, Roger and Flora Stewart of 786 Fishback Street. These people were totally unrelated to L/L and no City documentation to show a power-sharing contractual relationship between the two properties and owners. In fact, Roger had died (87 years old) a year before this permit was pulled, and Flora, his wife, 82 years old when the permit was pulled, died eighteen months later. Is this just another business-as-usual screw-up by the City of Manteca? Or, yet another example of Lyin' Lynda intimidating and defrauding the elderly neighbor woman? Who would be stupid enough, or frightened enough, or swindled enough, to lend their good name to Lyin' Lynda?



Oh... and TWO 10x12 growing sheds? Just how much dope do three honest women need? They should be very careful about spreading their joy painkiller around. Here's a cautionary tale from the Manteca Bulletin just before Valentine's Day.

Sierra High School v. Marijuana Farm Team

Here we go again...

America's grand experimental system of self-governance breaks down when selfish citizens do not voluntarily follow the laws adopted for the common good. And when the system of enforcement, designed to help the selfish ones comply, is overwhelmed, who is going to protect the public interest?

The Supreme Court of California, in People v. Kelly, filed January 21, 2010 [47 Cal. 4th 1008; 222 P.3d 186; 103 Cal. Rptr. 3d 733; 2010 Cal. LEXIS 113], in footnote 21 said,


At this point the Court of Appeal observed: “An argument against the CUA [1996 Prop 215] was [that] it ‘allows unlimited quantities of marijuana to be grown anywhere … in backyards or near schoolyards without any regulation or restrictions. This is not responsible medicine. It is marijuana legalization.’ (Ballot Pamp., Gen. Elec. (Nov. 5, 1996), argument against Prop. 215, p. 61.) San Francisco District Attorney Terence Hallinan responded, ‘Proposition 215 does not allow “unlimited quantities of marijuana to be grown anywhere.” It only allows marijuana to be grown for a patient's personal use. Police officers can still arrest anyone who grows too much, or tries to sell it.’ (Id., rebuttal to argument against Prop. 215, p. 61.)”

Two facts exist:
  1. The Barefoot Dirty Girls obviously have no intention to voluntarily conform to Manteca law about enclosing and securing their "weed patch."
  2. The City of Manteca obviously has no intention (or pretence) of enforcing its own law about enclosing and securing outdoor "weed patches."
Today, I sent the following email to the Manteca Unified School District superintendent and entire school board, the City of Manteca city manager and police chief, and the Manteca Bulletin newspaper editor.

Dear Mr. Messer,

This email is to inform you of an active marijuana growing operation just over the back fence (west) of Sierra High School, on the middle lot of the three residential lots located there - the one numbered as 810 Fishback Street. This information will assist you in continuing to protect the health, safety, general welfare and public morals of the students in your charge by nipping this unlawful use before it buds.

On July 8, 2010, I took some photographs of the marijuana plants to the Manteca Police Department and asked for an investigation (blog post and pictures here.) The next day the MPD called to inform me that the property owner held a medical marijuana card AND was also advised of Manteca’s Health & Safety ordinance, MMC 8.35 Cultivation and Possession of Medical Marijuana, which prohibits cultivation openly and unsecured. The owner was given a “few weeks” to enclose and secure the plants, but to date has failed to comply. Voluntary compliance with any law is something this owner never does; when informed of these laws the owner simply scoffs and ignores. The City of Manteca has briefly touched the situation, but without follow up or resolution, although “the purpose and intent of this chapter [is] to require that medical marijuana be cultivated in appropriately secured enclosed structures so as not to be visible to the public domain, to provide for the health, safety and welfare of the public.” (ibid.)

Manteca city law, Section 8.35.030 Cultivation Restrictions, in part, specifies:

B. Secure Enclosed Structure. The cultivation of medical marijuana shall at all times occur in a secure, locked, and fully enclosed structure that includes solid walls, a ceiling, roof or top. No outdoor growing shall be permitted within the city.

G. Collective or Cooperative Cultivation. For the collective or cooperative cultivation of marijuana, such cultivation shall be prohibited within any residential districts as defined by the Manteca Municipal Code or within one thousand feet of any residential district, school, recreation center, or youth center.
This pot farm is not a collective or cooperative, which has the 1,000 foot distance requirement. As a single-user grow on a residential lot - without the distance requirement - the Secure Enclosed Structure requirement is even more imperative, yet nothing but an easily scalable chain link fence separates one or more of your students (or an interloper) from a serious problem - with the law, dope, dogs or unstable scofflaws.

You, Mr. Messer, representing the Manteca Unified School District, are hereby informed of this potential “attractive nuisance.” Since the policy of your school board directs “The Superintendent … to work closely and cooperatively with [local] agencies, and to bring all areas of conflict to the Board of Education whenever it appears that they cannot be promptly and appropriately resolved,’ (Policy 1410, Community Relations, Local Units), I wish you success in resolving this situation with the unconcerned Manteca Police Department and the recalcitrant property owner.

How Crazy is Running For Manteca City Council?

A recent comment on the Manteca Bulletin Online system was made by someone who appeared to be a first-level student from the Rex Osborn Office of Double-Tongued Spin-Doctoring and Character Assassination, a city-paid position. There was an echo, a repetition, a redundant enunciation, another insinuation of the perjorative innuendo and slander leveled at me during Rex's clever misrepresentation of city (in)actions regarding my case and his intentional sowing of deprecatory seeds during the forty-minute public abortion at the March 3, 2009 City Council meeting. The subject was supposed to be the illegal activities of my neighbors and the city administration's refusal to enforce city codes - or even to review their own shirked responsibility for the whole sorry, sordid affair.

The commenter suggested I get counseling. Counseling?! Oh, I sought counseling, all right - legal counsel! Many, many dollars of legal counsel. Much more than I will spend on this campaign for city council.

Credentials? I am totally blown away by the inadequacies and irregularities that have surfaced in this so-called city during my three-year "campaign" against both my ignorant, nasty, noisy Neighbors From Hell and City Hall. I have graduated - pummelled, bloody, still standing - from a crash course offered by the Manteca Citizens College of Do-It-Yourself. I am the proud recipient of a Lifetime Go-To-Hell Degree, with gratuitous endorsements from the Police Department (Code Enforcement) and Community Development (Zoning).

The city folks I've dealt with on the other side of the cute, lily-white picket fence at 1001 W Center Street, Manteca, were all trained and graduated with a

One commenter gets it: "Bottom line, it's because this city will not lift a finger to assist him about these terrible neighbors."

And another: "Behling became interested in running because of the problems he's had with his neighbors and code enforcement but he's not a government employee or a career politician and seems to be smart enough so I'm going to vote for him."

And, to be fair and balanced, I include a back-handed endorsement by my ex-catering truck driver, pot-smoking neighbor, Mellow Yellow Lynda:

Ms. Allen: ... He has nothing else to do or he would not have written those two big books.
Mayor Weatherford: I don't think we want to get into the personal issues here.
Ms. Allen: Well, I try not to do that, but I'm just saying that somebody has a little extra time on their hands. (audience laughs)

Gotta love Lynda's gravelly voice, the Pinole-girl accent and her redneck humor. (Hey! That's HER word. "We like rednecks.")

The bottom bottom line is: These pathetic $^%$&^s next door and downtown are what it took to overcome my inertia, which inertia besets ANYONE who contemplates offering himself up for public office. It is the spark; it is NOT the whole explosion.

Hit the polls on November 2nd. Take all your friends, if any, with you. Vote for whomever you believe will give you the most responsive government to your wants  desires  welfare needs  legitimate needs. Between you and the few other voters who bother to show up that day, you will get the government you elect. You will get the government you deserve, whether you vote or not.

Don't Fight City Hall... Become City Hall

The lackadasical, slap-dash arbitrariness that is the hallmark of the City of Manteca comes about, no doubt, from the behind-the-scenes political chicanery in this town. Politicians selling themselves and/or their votes to the so-called "influencial" causes disjointed policies, supercilious law-making, and uneven enforcement of the laws they themselves adopted.

In a press release over the weekend, I compared the City of Manteca to the computer game, SimCity, where "the player as Mayor" runs his/her city in any old arbitrary manner as he/she deems fit. Sadly, that particular analogy didn't make it into yesterday's Manteca Bulletin announcement of my intention to run for Manteca City Council in the November 2010 election.

My personal task for the four-year term is to avoid the pits, traps, bombs, and flaming arrows of power brokers and entrenched special interests, both outside and inside city covernment. My altruistic task is to help the innumerable common citizens retake control of their city from the "the Mayor as player," other purchased politicians, and their SimCity supporters who wield the money and influence to their own enrichment at public expense.

A little enforcement of current zoning laws would be nice, too.

From Pencil to Print to Digital to Television... whew!

What a week! Never in my wildest dreams did I think this story would be broadcast to the entire Sacramento/Stockton television market area, which includes Manteca, even reaching coworkers in Modesto. Talk about unanticipated results from informing the local press…


The Friday after City Council meeting last week, I got a call from the Sun Post newspaper to schedule an interview this last Monday. The weekly paper publishes tomorrow (Friday). This is exactly what I hoped for – that I could get my case noticed by the press.

But, then… the news story below appeared on the Manteca Bulletin website late Monday night, also a direct result of my presentation to City Council of my research report. Dennis did a great job of laying out the case for his readers.

The next day, on Tuesday, Channel 13’s local news producer picked up the story from the Manteca Bulletin website and sent out Andrea, and Carl her cameraman, to do a 2-minute spot for the 10 o’clock news on Wednesday night. (That’s the link below.) They had already been to the police department, had already tried to speak with Allen or Brassey (but were declined – more gently than was the Sun Post reporter – by Corky), and were waiting for me when I arrived home from work.
